Terms of Service

1. Introduction

These Terms of Service ("Terms") govern your access to and use of the RetentionMate website and services. This agreement is legally binding between you ("User", "you", "your") and Sahil Bose, operating as RetentionMate AI("we", "us", or "our"), based in Jaipur, Rajasthan, India and Hyderabad, Telangana, India. By creating an account, purchasing a subscription, uploading data, or otherwise using RetentionMate's services, you agree to these Terms.

RetentionMate provides AI-powered customer churn prediction, data analysis, and retention strategy automation. By using our platform, you acknowledge that you understand the nature of our AI services and agree to comply with these Terms in full.

2. Description of Services

RetentionMate offers subscription-based software services, including but not limited to:

• Data Analysis: Processing user-uploaded CSV files containing customer usage data.
• AI Predictions: Utilizing third-party Large Language Models (LLMs) to predict customer churn risk.
• Retention Strategies: Generating AI-crafted email templates and retention suggestions.

3. User Obligations & Data Compliance

3.1 Account Setup

You must provide accurate and complete information during registration. You are responsible for the confidentiality of your credentials and all activity under your account.

3.2 Lawful Data Processing

By uploading CSV files or any customer data to RetentionMate, you represent and warrant that you have the lawful right, consent, and authority to process and share that data. You agree to comply with applicable data protection laws. You must not upload highly sensitive Personally Identifiable Information (PII) such as full credit card numbers, government IDs, or protected health information (PHI).

3.3 Prohibited Activities

You may not use RetentionMate for:

• Uploading illegally obtained or unauthorized customer data.
• Reverse-engineering the platform or our AI analysis logic.
• Using the service to train competing AI models.
• Hosting or transmitting malware within file uploads.

4. Pricing, Payments & Renewals

4.1 Merchant of Record

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns regarding your payment and billing. By purchasing a subscription, you also agree to Paddle’s Terms of Service and Privacy Policy.

4.2 Billing & Cancellations

All payments are billed in advance and automatically renewed unless canceled via your dashboard before the renewal date. Cancellations take effect at the end of the current billing cycle. Early cancellations do not qualify for partial or prorated refunds.

5. Intellectual Property & Data Ownership

RetentionMate retains all ownership rights in its software, systems, and branding. You retain all ownership rights to the raw data you upload. By uploading data, you grant RetentionMate a limited, secure license to process that data solely for the purpose of providing the churn prediction service to you.

6. Termination

Users may terminate their subscription at any time via the billing dashboard. RetentionMate reserves the right to suspend or terminate accounts without prior notice if a violation of these Terms, suspected fraud, or abuse is detected. Upon account deletion, all associated uploaded CSV data and prediction history will be permanently deleted from our servers.

7. Limitation of Liability

RetentionMate is not liable for:

• Loss of customers, revenue, or business profits.
• Inaccuracies, hallucinations, or errors in AI-generated predictions or text.
• Any indirect, incidental, or consequential damages.

Maximum liability is strictly limited to the amount paid for the service in the last 30 days.

8. Governing Law & Dispute Resolution

These Terms shall be governed and construed in accordance with the laws of Rajasthan and Telangana, India, without regard to its conflict of law provisions. Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the courts in Jaipur, Rajasthan and/or Hyderabad, Telangana, India.
